Attorney Danielle Bird Argues To Supreme Court

Recently, Bird, Stevens & Borgen, P.C. Attorney Danielle Bird argued before the Minnesota Supreme Court in support of a client who was injured on the job in 1988.

The client settled his claim in 1992, however, by 2009 he was having significant increases in his symptoms related to his 1988 work injury and required two additional surgeries. Because of his change in condition, the settlement from 1992 was set aside.

Danielle argued to the Supreme Court that the monies received from the settlement from 1992 should be paid back incrementally since it would be against the spirit of workers’ compensation laws in Minnesota to expect he forego benefits until that money is paid back.

Danielle is hopeful that her arguments were persuasive to the seven justice panel and expects a written decision from the Court in sometime in 2020.
